1. This Returns Policy applies to the Online Store www.f5r.eu ("Online Store").
2. A consumer who has concluded a distance contract may withdraw from it without giving a reason within 14 days from the date of taking possession of the purchased product ("Statutory right of withdrawal").
3. Only the Consumer is authorized to return the product. The return cannot be made by an entrepreneur who purchased the product in connection with his business. However, if the entrepreneur purchased the product for purposes not directly related to his business activity, he also has the status of a Consumer and is entitled to the statutory right of withdrawal.
4. To meet the deadline, it is enough for the Consumer to submit a declaration to the Seller before its expiry. The consumer may submit any clear declaration informing about his withdrawal from the Sales Agreement.
5. A declaration of withdrawal from the Sales Agreement may be submitted, for example, in electronic form via e-mail to the following address: info@f5r.pl;
6. The consumer may use the Return Form template, but is not obliged to do so.
7. The deadline for withdrawal from the Sales Agreement starts from the date the Consumer or a third party indicated by him, other than the carrier, takes possession of the products, and in the case of a Sales Agreement that covers many products that are delivered separately, in batches or in parts - from taking possession of the last product, batch or part.
8. The Consumer is obliged to immediately, no later than within 14 days from the date on which he withdrew from the Sales Agreement, return the product to the Seller. To meet the deadline, it is enough to return the product before its expiry.
9. The consumer should secure the returned product in such a way that it is not damaged during transport.
10. In the event of effective withdrawal from a distance contract, the sales contract is deemed not to have been concluded.
11. The Seller is obliged to immediately, but no later than within 14 days from the date of receipt of the Consumer's declaration of withdrawal from the contract, return to the Consumer all payments made by him, including the costs of product delivery (except for the costs of return shipment).
12. If the Consumer exercises the Statutory right of withdrawal, the Seller refunds the payment using the same payment method used by the Consumer, unless he has expressly agreed to a different method of return, which does not involve any costs for him.
13. If the Consumer exercises the Statutory right of withdrawal, the Consumer is liable for the reduction in the value of the product resulting from using it in a way that goes beyond what is necessary to establish the nature, characteristics and functioning of the product. The Consumer's liability may include, in particular, the inability to put the product on sale as a full-value product, the costs of putting tags and security elements back on the product, as well as the costs of restoring the Product to a condition that allows it to be re-sold in the Online Store, including the costs of testing the product by specialist and the costs of removing defects found as a result of such examination (to the extent that these defects result from the Consumer's use of the product in a way that goes beyond what is necessary to determine its nature, features and functioning).
14. The Consumer is not entitled to the statutory right of withdrawal in the event of:
14.1 exceeding the statutory deadline of 14 days to inform the Seller of the will to withdraw from the sales contract;
14.2 when the subject of the sales contract is a non-prefabricated item, manufactured according to the Customer's specifications or serving to meet his individual needs;
14.3 when the subject of the sales contract is a product that was in sealed packaging, the opening of which makes it impossible to return for health protection and/or hygiene reasons (e.g. underwear, swimwear).
15. This Returns Policy is an integral part of the Online Store Regulations and enters into force on January 1, 2024.
